1) Acceptance of these Terms

By accessing or using the Site, you agree to these Terms and our Privacy Policy and Accessibility Statement. If you do not agree, do not use the Site.

2) Who may use the Site

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You may use the Site only for personal, non-commercial real estate research and communications with us.

3) Changes to the Site and to these Terms

We may update the Site and these Terms at any time. The “Effective date” above shows the latest version. Continued use means you accept the updates.

4) No brokerage, legal, tax, or financial advice online

Content on the Site is general information. It is not legal, tax, investment, mortgage, or other professional advice, and does not create a broker-client, agent-client, or fiduciary relationship. Decisions about buying/selling/leasing real estate should be made with advice from appropriate licensed professionals.

5) Listings, IDX/MLS content, and accuracy

• Property listings and market data may be provided by one or more Multiple Listing Services (MLS) and third-party sources.

• Information is deemed reliable but not guaranteed and may change without notice. You are responsible for verifying all information (including price, availability, square footage, school district, taxes, HOA fees, and features).

• MLS/IDX content is for your personal, non-commercial use and may not be copied, redistributed, or used for any purpose other than identifying prospective properties for purchase or lease.

• All copyrights and other rights in MLS/IDX data belong to the respective MLSs and/or listing brokers.

• Some listings may have been sold, withdrawn, or may be subject to prior sale. Displayed timestamps, days-on-market, and similar indicators are not guaranteed.

6) Permitted use & prohibited conduct

You agree not to:

• Scrape, harvest, spider, or crawl the Site or listings (including via automated tools or bots).

• Circumvent security, rate limits, or access controls.

• Post, upload, or transmit unlawful, misleading, or infringing content.

• Interfere with Site operation or introduce malware.

• Use the Site to market or advertise your services without our written permission.

We may suspend or terminate access for violations.

7) Accounts, communications, and e-signatures

If you create an account or submit forms, you agree to provide accurate information and keep it updated. You consent to receive electronic communications from us (including emails and, if you opt in, texts) and to the use of electronic records and signatures for transactions where legally permitted.

8) Text messaging program terms (carrier-required)

If you opt in to receive SMS/MMS messages from us:

• You consent to receive texts related to your real-estate inquiry; consent is not a condition of purchase.

• Message frequency varies; message & data rates may apply.

• Reply “STOP” to cancel; reply “HELP” for help.

• Delivery depends on your carrier; carriers are not liable for delayed or undelivered messages.

• We may share your phone number with service providers only to deliver messages on our behalf and subject to confidentiality restrictions.

• We do not sell, rent, or share leads’ phone numbers with third parties for their promotional or marketing purposes.

9) Third-party services & links

The Site may link to or embed third-party tools (e.g., MLS/IDX feeds, maps, schedulers, analytics, mortgage calculators). We do not control these services and are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms.

10) Intellectual property

All content on the Site—including text, photos, logos, graphics, code, and design—is owned by us or our licensors and protected by intellectual property laws. Except for limited personal use described above, you may not copy, modify, distribute, display, or create derivative works without prior written permission.

11) Equal Housing Opportunity

We support Fair Housing. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, sexual orientation, gender identity, or any other protected class under federal, New Jersey, or local laws. Advertising and services are offered consistent with these laws.

12) New Jersey disclosures

We operate in New Jersey, USA. Certain real estate services may require separate written agreements that disclose duties, agency relationships, or compensation terms as required by NJ law and brokerage policy. Online content does not replace those agreements.

13) Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share information. Among other things, it confirms we do not sell leads’ phone numbers to third parties for promotional purposes.

14) Warranty disclaimer

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

15) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR BROKERAGE, AFFILIATES, AND SERVICE PROVIDERS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; ANY LOSS OF DATA, PROFITS, OR GOODWILL; OR AGGREGATE LIABILITY EXCEEDING US $100 ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF CERTAIN DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY.

16) Indemnification

You agree to defend, indemnify, and hold harmless Sarah Skaly, Real Broker, and our affiliates, officers, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Site; (b) your violation of these Terms; or (c) your violation of any law or third-party rights.

17) Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violations of these Terms. Sections that by their nature should survive (e.g., IP rights, disclaimers, limitations of liability, indemnification, and governing law) will survive termination.

18) Governing law & venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in New Jersey for any dispute arising out of or relating to the Site or these Terms.

Optional (consult counsel): If you prefer arbitration and a class-action waiver, ask counsel to add a binding arbitration clause compliant with the Federal Arbitration Act and applicable state law.

19) DMCA/copyright complaints

If you believe content on the Site infringes your copyright, contact sarah@skalyrealty.com with: (a) your contact info; (b) identification of the copyrighted work and the allegedly infringing material (URL); (c) a good-faith statement; and (d) a statement under penalty of perjury that you are the copyright owner or authorized agent. We may remove or disable access to the content as appropriate.

20) International use

The Site is controlled from the United States and intended for use in the U.S. We make no representation that content is appropriate or available in other locations. If you access from elsewhere, you do so at your own risk and are responsible for compliance with local laws.

21) Severability & waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver.

22) Entire agreement

These Terms, together with the Privacy Policy and any additional written agreements you enter into with us regarding specific services, constitute the entire agreement between you and us regarding the Site.
